MEMBERS OF FIRM<p><b>James L. Aab</b> (Managing Member) admitted to bar, 1974, Colorado; U.S. District Court, District of Colorado; U.S. Court of Appeals, Tenth Circuit; U.S. Bankruptcy Court, Southern District of New York; U.S. Bankruptcy Court, Northern District of Illinois. <b>Education:</b> University of Minnesota (B.S.B., with distinction, 1970); University of Illinois (J.D., 1973). James L. Aab has had a private law practice in Denver, Colorado since 1974. In 1998, he was a founding member of the law firm of Aab & Botts L.L.C. Mr. Aab's practice focuses primarily in the areas of commercial real estate-landlord/tenant matters, bankruptcy and business/contract law matters, including litigation in these areas. <p>Mr. Aab has represented a number of major regional, community and strip-center shopping centers in the Denver metropolitan area, as well as banks, insurance companies and commercial real estate owners and developers, in a variety of real estate, bankruptcy and business matters. <p>Mr. Aab's bankruptcy practice has covered proceedings under every chapter of the Bankruptcy Code except Chapter 9 and 15. Representation in Chapter 7, 11 and 13 proceedings has been for debtors and creditors including numerous business-related filings involving national companies to local, small business entities. Mr. Aab has worked as a creditor's counsel in numerous Chapter 11 reorganization cases including Montgomery Ward, County Seat, Wilson's Leather, Vista Optical, Samuel's Jewelers, Zales Jewelers, K-B Toys, Athlete's Foot, Prints Plus, Ritz/Wolf Camera and Shoebox Jewelers, to name a few. Mr. Arab's bankruptcy experience includes motions for relief, motions for adequate protection, preference claims, motions to assume and assign leases and contracts, the payment of administrative rent and other claims, lease rejection claims, objections to discharge and property valuation disputes. <p>Mr. Aab's real estate experience includes mechanic's lien claims, quiet title and specific performance suits, condemnation matters, free speech access rights on private property as well as tenant eviction and lease collection matters. In 1978, Mr. Aab represented a tenant in a case before the Colorado Supreme Court which established the legal procedure for landlord/tenant bailment issues in real estate. <p>Mr. Aab's business practice experience includes handling numerous transactions involving the sale and purchase of business. <p>Mr. Aab has been a member of the Denver and Colorado Bar Associations since his admission to the Colorado Bar. Mr. Aab is a member of the Denver Bar Fee Arbitration Committee since approximately 1990. He also served as Supervisory Committee Chairman of the Denver Bar Association Credit Union from 1994 to 2002. Mr. Aab served four years on the Board of his HOA from 2003 through 2005, one year as the President of the Board. Mr. Aab also volunteers for various pro bono activities of the Denver Bar Association including presenting bankruptcy seminars in conjunction with the United States Bankruptcy Court for the District of Colorado. Robert Botts, Jr. has practiced law in Denver, Colorado for over 19 years. Robert is the managing member of Aab & Botts, LLC, a firm that provides legal services in the areas of commercial law, corporate law, general commercial litigation, real estate and bankruptcy. <p>Robert practice includes: commercial law; general corporate law; and real estate law, with particular emphasis in the areas sales and acquisitions of business and commercial finance and lending. <p>Robert has extensive experience in drafting and negotiating contracts: including, partnership agreements, joint ventures agreements, limited liability company operating agreements, stock purchase agreements, real estate agreements, service agreements, license agreements and other domestic and international commercial contracts. <p>Robert has represented numerous clients in the energy and financial industries. Robert is certified by the National Association of Development Companies to provide legal counsel to certified development companies regarding the Small Business Administration 504 loan program. He also works with emerging business from the start-up stage to established operating entities and he acts as outside general counsel for several privately-held companies. <p>Robert regularly advises clients in connection with general business matters, business strategies, establishment of strategic relationships, formation of new business entities, both domestic and international. Robert also handles a variety of real estate transactional matter for clients. <p>Robert has represented clients in various litigation matters in the areas of contract disputes, banking, financing, real estate and environmental issues. <p>In 1997, Robert was appointed by Governor Romer to serve as a Colorado Department of Transportation Commissioner and represented the City and County of Denver. During his term as Commissioner, Robert was involved in extensive strategic planning and public outreach efforts concerning a major Colorado construction project designed to meet the Southeast Corridor traffic demands. The project was referred to as the Transportation Expansion Project or "T-REX."
